Introduction

Welcome to the (Ithnain) application for health education for diabetic patients. The application is an electronic platform for providing health services to individuals, which aims to be the health guide for citizens and residents of the Kingdom of Saudi Arabia in integration with health services and systems.


By using and/or browsing the application, the user agrees to accept and abide by the terms and conditions of use, undertakings, privacy policy and all relevant regulations in the Kingdom of Saudi Arabia. Please read the following terms and conditions carefully before you start using and benefiting from the application

2. Definitions

  • "Patient": An Affected Person who accesses and/or uses any of the services provided through the Application.
  • "Educator": The trained person who accesses and provides any of the services available through the App.
  • "Application Management": Shall mean the owner of the App and/or the partners and/or assignees of the King to manage the affairs of the App and to oversee and/or provide the services available through the App.

3. User Undertakings

  • Not to provide false, misleading or fraudulent information or data, or use forged documents.
  • The user shall bear all fines imposed by the competent authorities or by any legal authority based on his violation of any of the regulations in force in the Kingdom of Saudi Arabia.
  • Maintain the confidentiality of his/her application login credentials and not make them available for use by other persons.
  • Not to submit or upload files to the Application that contain malware, viruses or corrupted data.
  • Refrain from accessing or attempting to access any data or information unlawfully.
  • Not use any means, program, or procedure to intercept or attempt to intercept the proper operation of the Application.
  • Not to submit or upload files containing software, materials, data or information that are owned by third parties and for which they do not have a license.
  • The User is obligated to use the Application for the purposes for which it is intended, and his/her use of the Application and utilization of the Services shall be personal to the User, and he/she shall not enable any other party to use the Application or benefit from its Services.

4. User Obligations When Starting Service

  • The user must ensure a strong and continuous internet connection for at least 45 minutes before starting the service.
  • It is the user's responsibility to check the battery of the device used and ensure internet connectivity and performance stability, in addition to choosing a quiet place to ensure a suitable learning environment.

5. Subscription Period

  • The subscription period is for a specific period of time, and is attached to the invoice after payment or transfer from the user or his/her payment sponsor.
  • The subscription starts from the activation date and continues for a specific period according to the package subscribed to (7 days, 30 days, 60 days, 90 days, or 365 days), with the subscription period ending automatically upon the expiration of the specific period calculated from the day of activation.
  • The user has the right to inquire about the terms and conditions of use of the subscription to avoid not being compensated for any of the above-mentioned points.
  • Use of privileges
    • The user is entitled to utilize all the specified subscription privileges during the subscription period. These privileges include:
    • - Booking appointments to suit the client's time.

      - Attend scheduled sessions.

      - Chatting with the Educator

      - Making amendments or canceling bookings, provided that this is done within the prescribed period (maximum two hours before the session date).

  • Compensation and time commitment

      - If the User does not use any of the subscription privileges in the manner indicated or during the specified subscription period, the User will not be entitled to any compensation for the unused privileges after the end of the subscription period.

      - All privileges and services are automatically canceled at the end of the subscription period without any obligation on the App to provide any compensation.

  • Time limit for cancellation or modification

      - The User is obligated to make amendments or cancellations to his/her reservations at least two hours before the session date, in order to be able to provide the service to third parties in the considered period.

      - If the aforementioned period is not adhered to, the application reserves the right to refuse the modification or cancellation without providing any compensation.

  • Handling of special requests after the end of the subscription

      - Once the subscription period expires, all privileges and services provided are considered null and void, and no requests for modification or compensation will be allowed under any circumstances.

      - Exceptions are made in cases where there is a prior written agreement between the user and customer service.

  • Force majeure and technical issues

      - The App does not assume any responsibility for the user not benefiting from the privileges due to circumstances beyond his/her control (such as force majeure, natural disasters, illness or crisis) unless notified in advance.

      - In the event of a system failure or technical errors on the part of the application that affect the user's ability to use the privileges during the subscription period, the application is obligated to provide an appropriate extension or alternative solutions.

  • Non-refundable and non-assignable

      - The subscription provided is not refundable or assignable to any other party.

      - All privileges provided within the subscription are solely for the registered user and may not be transferred or shared with any other person.

  • Definition of privileges

      - Privileges include all services specified during the subscription only, such as booking appointments, attending sessions, and chatting with the educator.

      - Subscription does not guarantee continued access to the previously mentioned services after the end of the subscription period.

  • Acceptance of Terms and Conditions

      - The User's registration for the Service constitutes full and final acceptance of all the terms and conditions contained herein.

      - It is the user's responsibility to read and understand these terms and conditions before subscribing.

  • Recommendations

      - The User is advised to adhere to the scheduling of appointments and utilize all privileges during the subscription period to ensure maximum benefit from the service.

      - The user should contact the app management immediately in case of any issues or queries to ensure the necessary support is provided.

6. Cancellation and refund terms

  • Refund requests can be received after payment within the first 24 hours, provided that the first session of the package has not been taken.
  • The session will be canceled and counted against the package's session balance if the user is 10 minutes late from the scheduled start time of the session.
  • If two consecutive sessions are not attended without prior notice, they will be counted as one session consumed within the package, and the user will not be reimbursed for it.
  • You can cancel your reservation up to two hours before the appointment to avoid forfeiting the booking fee, but if you wish to cancel less than two hours before the appointment, the booking fee will not be refunded and will not be reimbursed.

7. Reimbursement if the specialist is late

  • The user will be reimbursed for one session if the educator is late without prior notification.
  • The user will be reimbursed for one session only if the educator is absent.

8. useOfDataForResearchPurposes

  • The Ithnain app is allowed to use user data for research purposes aimed at clinical and health development, while anonymizing data that may identify the user.
  • The management of Ithnain app is allowed to use the data for the purposes of preparing studies, statistics and improving the service, provided that the use is aggregated and cumulative, while maintaining the confidentiality and privacy of the user's identity.

9. Use of external links:

  • The app administration is not responsible for the privacy policies of external websites linked to the Ithnain app.
  • Special communication links may be provided for the purpose of facilitating the user, and the user must take the necessary measures and precautions to protect his data and privacy when using these links.

10. User rights (your personal rights):

  • The user has the right to access their data, correct it, request account deactivation, and withdraw consent to view the health profile.
  • All of our text and voice consultations are recorded and their use is subject to data protection laws and the protection of the user's privacy.

11. User Responsibility for Privacy

The user must take adequate measures, precautions and/or procedures to protect his/her data and privacy when using the application and utilizing the services, especially those related to using a secure browser, checking the level of protection on the device used to access the application and updating contact information, and the customer shall be solely responsible for any damages that may occur as a result of neglecting these measures.

12. Updating the Terms of Use

The administration of the application reserves the right to amend the terms of use and privacy policy with notice to the user.

13. Ethical rights

  • The recipient of the service must abide by public ethics and behaviors, and Ithnain Platform (the application) has the right to stop the service if the recipient of the service (the user) violates any of the prevailing and accepted public ethics and behaviors in the Saudi society.
  • Not to use this platform in any way to send any commercial messages, advertising and promotional messages, spam or other unsolicited messages that constitute an abuse of the platform or the contact information provided therein or cause inconvenience to the application administration, other users or others.
  • The user is prohibited from posting, sending or receiving any illegal, pornographic, threatening, defamatory, obscene, inflammatory, offensive to the religious beliefs of others or to public morals or any material that may involve abusive behavior or may violate morals, a criminal offense, an offense that entails civil liability or a violation of the law, for which the user shall be solely responsible to the application, the injured party or public authorities.
  • Refrain from publishing, announcing, distributing or disseminating materials or information containing defamation, violation of laws, pornography, obscenity, violation of Islamic teachings or public morals through the Platform, or placing the Platform in violation of any applicable law or regulation in any field.
  • The User is prohibited from using the Application for illegal or unlawful activities in the Kingdom of Saudi Arabia.

14. Disclosure to third parties

  • We will not disclose or share your data with any third parties, except for:

      - Disclosure to government agencies as required by the regulations and laws in force in the Kingdom of Saudi Arabia or by orders from the competent authorities.

      - Disclosure to entities authorized by the target entities or the application management to receive and pass data when the implementation of the service requires accessing, storing, processing and using such data by any of these entities.

      - In the event of using a third party or third party support, we will use reliable and authoritative entities, and require them to adhere to our confidentiality standards and take the necessary guarantees and undertakings to ensure data privacy and confidentiality of information, including signing confidentiality agreements with any such parties.

  • Disclosure to parties outside the Kingdom of Saudi Arabia:

      - We will not disclose or process your personal data outside the Kingdom of Saudi Arabia, unless we obtain the necessary consents, either from you or the relevant governmental authorities, if necessary or to fulfill the purposes for which it was collected and processed in the first place.

15. Content

  • The platform administration reserves the right to monitor any content entered by the user, but it is not obligated to do so, and the user remains responsible for all the consequences of the content entered by the user. The platform administration reserves the right (without obligation) to delete, remove or edit any input material that the platform administration deems inappropriate or that may violate these terms and conditions.

16. Termination of use

  • The app administration may, at its sole discretion, terminate, restrict or suspend a user's right to access and use the app for any reason deemed necessary by the app administration, including violation of these Terms of Use or the Privacy Policy, or any other behavior that is illegal or harmful to others.

17. Updating Terms of Use and Policies

  • The platform administration reserves the right to update these Terms of Use as well as the Privacy Policy from time to time with the platform administration notifying the user.

18. Disclaimer

The application management endeavors to ensure the accuracy, correctness and completeness of the information available on the application and to provide the services in an effective and continuous manner. However, we disclaim all responsibility for not achieving what we seek, and we emphasize and inform the user of the following:

  • The services provided through the Application and the information and materials available on or accessible through it are provided for use 'as is' and 'as available' without any representation, promises or warranties of any kind, and we cannot guarantee or be responsible for any interruptions, errors or omissions that may arise from the use of this Application or its contents, whether with or without our knowledge.
  • No liability for any claims, losses, costs, expenses, or damages of any kind without limitation, general, special, incidental, consequential (arising from any cause), or punitive based on any theory of liability, regardless of the foreseeability of such losses, damages, expenses, damages, or attorneys' fees in connection with any use of the Online Application and the information contained therein, including but not limited to:
    • Any failure of performance, error, inadequacy, interruption, defect or delay in operation or transmission whether due to connection or Internet access issues, equipment or software malfunctions, technical issues or defects or otherwise.
    • The presence of viruses, malware, system malfunction or error.
    • Any intrusion into the system or the data contained therein or any fraudulent or unauthorized use of the Password by any other person.
    • Failure to receive any email or entry received by the App regarding technical issues.
    • Terminate, restrict or suspend the User's right to access and use the Application in accordance with clause (16. Termination of Use).
    • The user of this application acknowledges that he/she waives any right to any claim or complaint against the application administration or any of its management arising from his/her use of the application or his/her reliance on any of its contents.

19. Language

  • The Arabic language is the primary language for using the application and benefiting from all the materials published on it. Some materials, including laws and regulations, may be subject to translation into other languages to interpret their meanings in order to increase their usefulness, as an added service, but the Arabic text of all these materials constitutes the main reference, and the available translation will not be relied upon to interpret any dispute about the content contained in the application.

20. Claims and Disputes

  • Use of the App is subject to the exclusive jurisdiction of the judicial authorities of the Kingdom of Saudi Arabia with respect to all claims and disputes arising therefrom.
  • The Arabic language is the official language used to resolve any disputes arising from your use of the App or any of its contents.
  • The delay (about) or refraining from demanding, tolerating or tolerating the use of any of the rights and/or powers assigned to it under these terms and conditions will not constitute or be interpreted in any way as a waiver of that right or power, and the waiver of any of those rights and/or powers - as an exception - in one place, occasion or special circumstances or for one person, does not in any way mean an automatic and permanent waiver of that right and/or power in other places, occasions or circumstances or for other persons.

21. Property Rights
